Terms and Conditions

1. These terms. These terms apply to our quotes, estimates, work and invoices. A "consumer" is a person using us for their own home. A "business client" is anyone instructing us in the course of business (for example contractors, landlords, letting agents, insurers and loss adjusters). Some clauses apply to only one of these, as marked. Nothing in these terms affects a consumer's statutory rights.

2. Our work. We will carry out all work with reasonable care and skill. We will correct any genuine errors or omissions in our quotes, estimates or invoices (errors and omissions excepted).

3. Quotes, estimates and recommendations. A quote is a fixed price for the work described and is valid for 30 days. An estimate is our best guess, not a fixed price. We will tell you before the cost goes more than 10% above an estimate. Recommendations shown on an invoice or report are separate quotes for optional work. They are not included in the invoice total and are not carried out unless you accept them.

4. Unforeseen conditions. Sometimes we find problems that could not reasonably have been seen beforehand. Examples include collapsed or displaced pipes, root ingress, unknown or unmarked services, adverse ground conditions, unexpected obstructions or earlier poor work. If this happens, we will stop, explain what we have found and agree any extra work and cost with you before carrying on. We will not increase our price for delays caused by the weather.

5. Access, permissions and underground services. You agree to give us safe access, a water supply where needed, and any permission needed from neighbours, landlords or freeholders. You also agree to share any plans or information you have about drains and services. We take reasonable care to locate and avoid underground services. We are not responsible for damage to a service where any of the following apply, unless we failed to take reasonable care:

  • it is shallower than 450 mm and not marked with warning tape or tiles;

  • it is not where the plans or information given to us showed;

  • it is not adequately protected by ducting;

  • it was already corroded or defective.

6. CCTV surveys and reports. A CCTV survey records the condition of the drain on the day, and only of the sections the camera could reach. Blockages, water, debris, bends or lack of access may stop part of a survey. We will say so in the report. Distances and locations found by tracing are approximate. A survey cannot show future defects, or defects in sections that were not surveyed. Full CCTV survey reports and footage are released once the invoice has been paid in full.

7. Blockages and repeat visits. Clearing a blockage does not stop it recurring. A return visit is chargeable if the blockage is caused by misuse or by a defect in pipework or drains outside the work we carried out. Misuse includes fats, wipes, sanitary products and foreign objects. Such defects include shared or neighbouring drains, public sewers and work by others.

8. Guarantees. New work we carry out (repairs, replacements, relining and installations) is guaranteed against faulty workmanship for 1 year from completion. Any manufacturers' warranties on materials are passed on to you. Clearing blockages is not guaranteed, and nor is existing pipework we have not replaced or repaired. This guarantee is in addition to your statutory rights.

9. Payment. Payment is due in full on the day the work is completed or, if later, the day we issue the invoice (shown on the invoice as "NET 0", with the due date the same as the invoice date). Please pay by bank transfer or card, using the details on the invoice. If an insurer or agent is paying, the person who instructed us remains responsible for any excess or any amount they do not pay.

10. Ownership. Materials we supply remain our property until paid for in full, as far as the law allows. Our equipment, including hired equipment, remains ours at all times.

11. Liability. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

  • Consumers: we are responsible for loss you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

  • Business clients: we are not liable for indirect or consequential loss (including loss of profit or rent), and our total liability is limited to the amount recoverable under our public liability insurance (currently £1,000,000).

12. Your right to cancel (consumers). If you agreed the work at your home, or by phone or email, you may cancel within 14 days of agreeing it, without giving a reason.

  • If you ask us in writing (text or email is fine) to start within those 14 days and then cancel, you pay for the work done up to that point.

  • If we complete the work at your request within the 14 days, you can no longer cancel.

  • There is no right to cancel where you specifically called us out for urgent repairs. This does not apply to any extra work you agree on the day.

13. Questions or complaints. Please contact us first at info@abdrainworks.co.uk or 07917726634, and we will try to put things right.
